Terms of service.

These Terms of Service ("Terms") govern your use of tidepoolbeauty.shop and any purchase from Tidepool Beauty LLC. By using the Site or placing an order, you agree to these Terms.

1. Eligibility and accounts

You must be at least 18, or the age of majority where you live, to place an order. You are responsible for the accuracy of the information you provide at checkout.

2. Products

We sell authentic products purchased from the brands or their authorized distributors. Product descriptions, shades and ingredient lists are supplied by the brands; formulas occasionally change, so the packaging you receive is the authoritative ingredient list. Colors on screen may differ slightly from the product in hand. Cosmetics are for external use only; discontinue use if irritation occurs and consult a doctor if it persists.

3. Prices and payment

All prices are in US dollars. We may change prices at any time, but the price charged is the one shown when you placed your order. Sales tax is added where required. Payment is taken when you place your order and is processed by Stripe; see our Privacy Policy. If a product is mispriced because of an obvious error, we may cancel the order and refund you in full.

4. Orders

Your order is an offer to buy. We accept it when we ship the items. We may limit quantities, refuse or cancel an order - for example for suspected fraud or reseller activity - in which case we will refund any amount charged.

5. Shipping, risk and title

We ship to addresses in the United States. Title and risk of loss pass to you when the carrier delivers your package. Delivery estimates are not guaranteed. See Shipping & returns for details.

6. Returns and refunds

You may return products within 30 days of delivery, opened or unopened, under the terms of our returns policy. Refunds go to the original payment method.

7. Intellectual property

The Site's design, text and graphics belong to Tidepool Beauty LLC or are used with permission. Brand names, logos and product names belong to their respective owners and are used to identify the products we sell; their use does not imply endorsement of Tidepool Beauty.

8. Acceptable use

Do not misuse the Site - for example by attempting to access it without authorization, scraping it at scale, interfering with its operation or using it for unlawful purposes.

9. Disclaimers

The Site and its content are provided "as is". Information on the Site, including product advice from our team, is general in nature and is not medical advice. To the fullest extent permitted by law, we disclaim all implied warranties other than those that cannot be excluded.

10. Limitation of liability

To the fullest extent permitted by law, Tidepool Beauty LLC is not liable for indirect, incidental or consequential damages, and our total liability for any claim relating to an order is limited to the amount you paid for that order.

11. Governing law and disputes

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Gallia County, Ohio, and you consent to their jurisdiction. Nothing in these Terms limits rights you have under applicable consumer protection law.

12. Changes

We may update these Terms. The version posted when you place an order applies to that order.
